CallsOfCare.org may, in its sole discretion, modify or revise these Terms of Use at any time by updating this web page. You are bound by any such modification or revision and should, therefore, visit this page periodically to review the terms. All references, protections, benefits, and limitations of liability set forth in these Terms of Use and applicable to CallsOfCare.org apply equally to CallsOfCare.org’s owner.
1. SERVICES
CallsOfCare.org provides a matching service that allows you to input your information once and receive calls from a student volunteer to provide companionship and connectedness. There is no charge to consumers for the use of our matching service. By using this service, you expressly waive any claim against us relating to the quality of any volunteer we match you with and understand that we are not responsible for the quality of any services.
By using our service and providing your personal contact information, you agree that the volunteer you are matched with may contact you by telephone. You request and expressly consent to receive any telephone call without limitation of any wireless telephone number. You acknowledge that such consent is not a condition of purchase.
Any financial or other relationship entered into between you and any third party that arose from information received or accessed through this website or CallsOfCare.org is solely between you and the third party. CallsOfCare.org is not a party to your agreements and you assume sole liability for any such agreements.
Should you have a dispute with any of CallsOfCare.org’s volunteers, representatives or ambassadors that you are matched with, you must address such dispute to the volunteers, representatives or ambassadors directly, and by using this website you hereby agree to release CallsOfCare.org (and our affiliated volunteers, representatives, and ambassadors) from any damages or claims (including consequential and incidental damages) of every kind or nature, suspected and unsuspected, known and unknown, and disclosed or undisclosed, arising out of or in any way connected with such disputes and your dealings with such matched individuals or organizations.
We value our integrity and as a company and individuals, we are committed to providing you with a positive experience. If for any reason, you are not completely satisfied with our service, please email us at CallsOfCare@gmail.com to discuss your concerns.
2. YOUR USE OF CallsOfCare.org SERVICES
You agree that by submitting your personal information to CallsOfCare.org, you are entering into a business relationship with CallsOfCare.org, requesting that it distribute your information to its volunteers, and you expressly consent and request to be contacted by CallsOfCare.org, its volunteers, representatives, and ambassadors even if the entered telephone number is currently on a federal, state, or wireless Do Not Call list. You acknowledge that such consent is not a condition of purchase. It is expressly understood that these telephone calls are being made pursuant to your request for such communications. These contacts are necessary so that that we may provide the services set forth on our site that you requested.
It is agreed that your use of CallsOfCare.org services is for the purposes provided therein and not for any other purpose including advertising or competitive intelligence. You acknowledge that CallsOfCare.org screens your requests and has the right (but not the obligation) in our sole discretion to deny any request that is in violation of these Terms of Use.
If it is determined or suspected by CallsOfCare.org in its sole discretion that you are misusing or attempting to misuse or circumvent the CallsOfCare.org services or system, or are using or attempting to use it for any inappropriate purposes, including but not limited to activities such as hacking, fraud, advertising, cartelling or spamming, CallsOfCare.org reserves the right, in its sole discretion, to immediately terminate your access without notice and to instigate without notice appropriate legal actions or proceedings to seek appropriate remedies and/or damages, including, but not limited to, lost revenue, repairs, legal fees, costs and expenses, and to seek injunctions or other equitable remedies.
3. INFORMATION YOU PROVIDE TO US
When using CallsOfCare.org services, you will be prompted to disclose certain information about yourself and your personal situation. This information will be sent to matching individuals which will need this information to respond to you. You promise that you are at least 18 years of age. You promise that all information you provide will be accurate, current, and truthful to the best of your knowledge. If you provide any information that is untrue, not current or incomplete, or CallsOfCare.org has reasonable grounds to suspect that such information is untrue, inaccurate, not current, or incomplete, CallsOfCare.org has the right to refuse you any current or future use of the CallsOfCare.org services. Your acceptance of these Terms of Use indicates that you expressly consent to our use and disclosure of your personal information in accordance with our Privacy Policy.
We will not, in any circumstances, share your personal information with other individuals or organizations without your permission, including public organizations, corporations, or individuals, except when applicable by law. We do not sell, communicate, or divulge your information to any mailing lists.
4. NO WARRANTIES
CallsOfCare.org does not fully evaluate any individual who is accessible through this website. While we use some care in selecting our associates and affiliates, we make no express or implied warranty or representation, nor are we liable for any direct, indirect, or consequential damage arising in connection with respect to any of the programs or services.
5. FOR ALL VOLUNTEER BASED POSITIONS
As a registered volunteer for the CallsOfCare.org and for all volunteer related events and activities, you do hereby discharge CallsOfCare.org, the event site, their management, officers, board members, employees, members, ambassadors, volunteers, representatives and their successors, and all cooperating businesses and organizations, from all claims of damages, demands, actions and causes whatsoever in any manner arising from or growing out of your participation in a CallsOfCare.org activity, event or fundraiser.
All volunteers will conduct all volunteer activities with high standards, professionalism, and good taste, and will do nothing to cause detriment to the reputation or goodwill of the CallsOfCare.org.
A volunteer will not, in any circumstances, share a client’s personal information with other individuals or organizations without their permission, including public organizations, corporations, or individuals, except when applicable by law. Volunteers will not sell, communicate, or divulge a client’s information to any mailing or calling lists.
If CallsOfCare.org determines, in its sole discretion, that the volunteer activities could injure the goodwill or reputation of CallsOfCare.org, CallsOfCare.org may terminate this Agreement immediately. Upon the expiration or sooner termination of volunteer, I shall discontinue using the CallsOfCare.org name and logo and all materials that reference CallsOfCare.org
This agreement constitutes the entire agreement between you and CallsOfCare.org with respect to this site and it supersedes all prior or contemporaneous communications and proposals, whether electronic, oral or written, between you and CallsOfCare.org with respect to this site. A printed version of this agreement and of any notice given in electronic form shall be admissible in judicial or administrative proceedings based upon or relating to this agreement to the same extent and subject to the same conditions as other business documents and records originally generated and maintained in printed form.
